SIGNATURE ART DIGITAL IMAGES
PERSONAL USE & NO COMMERCIAL USE AGREEMENT
Sugar & Spice Photography, LLC
This Agreement is entered into between Sugar & Spice Photography, LLC ("Sugar & Spice," "Photographer," "we," "us," or "our") and the undersigned client ("Client," "you," or "your") regarding the purchase and use of photographs created by Sugar & Spice Photography.
1. PERSONAL USE ONLY
Client acknowledges and agrees that all Signature Art Digital Images purchased from Sugar & Spice Photography are licensed SOLELY FOR CLIENT'S PERSONAL, NON-COMMERCIAL USE.
Purchase of Signature Art Digital Images does not transfer copyright or ownership of the photographs to Client.
All copyrights and intellectual property rights in the photographs remain exclusively with Sugar & Spice Photography unless otherwise expressly agreed to by Sugar & Spice Photography in a separate written agreement.
2. COMMERCIAL USE IS STRICTLY PROHIBITED
Without the prior written authorization of Sugar & Spice Photography, Client may NOT use, display, publish, reproduce, distribute, transmit, modify, license, sell, promote, advertise, or otherwise use any purchased photograph for:
Any business, company, brand, or commercial enterprise;
Advertising or marketing of any goods or services;
Promotion of any business, occupation, profession, or commercial activity;
Paid or monetized websites, social media accounts, subscription platforms, or online services;
Business profiles, professional profiles, promotional portfolios, or advertisements;
Escort, adult-entertainment, sexually oriented, companionship, dating, or similar commercial services;
Any service for which Client receives, or intends to receive, payment, compensation, tips, subscriptions, commissions, memberships, or other financial benefit;
Any third party's commercial or promotional purposes;
Any website, platform, account, publication, advertisement, or other medium used primarily to promote or generate income from a business or service.
For avoidance of doubt, Client may not use photographs purchased from Sugar & Spice Photography as promotional or advertising material for any business or income-producing activity, regardless of the platform on which the photographs appear.
3. PERSONAL SOCIAL MEDIA USE
Client may use purchased Signature Art Digital Images on personal social media accounts for personal, non-commercial purposes, provided that such use does not promote, advertise, solicit, or generate income for any business, service, occupation, or commercial activity.
If an account, profile, page, website, or platform is used in whole or in part to promote or generate income from a business or service, photographs from Sugar & Spice Photography may not be used on that account, profile, page, website, or platform without prior written authorization.
4. NO TRANSFER OR LICENSING
Client may not sell, transfer, sublicense, license, rent, assign, gift for commercial use, or otherwise provide the photographs to another person, business, company, organization, website, publication, or commercial platform for commercial or promotional purposes.
Client may not authorize another person or business to use the photographs commercially.
5. NO ALTERATION FOR COMMERCIAL PURPOSES
Client may not crop, alter, edit, filter, retouch, composite, manipulate, or otherwise modify the photographs for any commercial, promotional, advertising, or income-producing purpose.
6. COPYRIGHT REMAINS WITH SUGAR & SPICE PHOTOGRAPHY
Client expressly acknowledges that purchasing Signature Art Digital Images does NOT constitute a purchase or transfer of copyright.
The Client receives only the personal-use rights expressly provided by Sugar & Spice Photography.
Except for the limited personal-use license expressly granted herein, all rights are reserved by Sugar & Spice Photography.
7. AGREEMENT TO EXISTING TERMS & CONDITIONS
Client acknowledges that Client has read and agrees to be bound by the complete Sugar & Spice Photography Terms & Conditions located at:

Those Terms & Conditions are incorporated into this Agreement by reference.
Client specifically acknowledges the provisions concerning:
Personal-use photography sessions;
Prohibition of commercial use without written authorization;
Copyright and ownership;
Restrictions on copying, reproducing, distributing, publishing, transmitting, altering, or otherwise using photographs;
Prohibited uses and services;
Client indemnification obligations; and
Sugar & Spice Photography's enforcement of its copyright and usage rights.
If there is any conflict between this Agreement and the general Terms & Conditions, the more restrictive provision concerning commercial use of Client's photographs shall control, to the extent permitted by applicable law.
8. CLIENT ACKNOWLEDGMENT
By signing below, Client specifically confirms that:
I understand that the Signature Art Digital Images I am purchasing are for my personal, non-commercial use only.
I understand that I may NOT use these photographs to advertise, promote, market, solicit clients for, or otherwise support any business, occupation, profession, commercial service, monetized platform, or income-producing activity.
I understand that purchasing the digital images does not give me copyright ownership of the photographs.
I understand that I must obtain written permission from Sugar & Spice Photography before using any photograph for a commercial purpose.
I have read and agree to the Sugar & Spice Photography Terms & Conditions and agree that this Agreement is an additional, binding acknowledgment of the restrictions applicable to my purchased photographs.
9. VIOLATION OF THIS AGREEMENT
Any unauthorized commercial or promotional use of the photographs constitutes a violation of this Agreement and the Sugar & Spice Photography Terms & Conditions.
Sugar & Spice Photography expressly reserves all rights and remedies available under applicable law, including its rights as copyright owner, in the event of unauthorized use.
Client agrees to immediately cease any unauthorized use upon written notice from Sugar & Spice Photography.
